B2B ECOMMERCE GENERAL TERMS AND CONDITIONS OF SALE
GENERAL INFORMATION
These General Terms and Conditions regulate the online sale of goods and products made available via the Internet, on the website www.antifurtoarnia.it (hereinafter "Site"), in compliance with the provisions of Legislative Decree No. 70/2003.
The sales contract is entered into between the company and the Buyer as identified by the data provided at the time of purchase, through their legal representative pro tempore or otherwise by an attorney expressly authorized to enter into this agreement.
The Buyer who registers in order to purchase goods offered for sale is required, before submitting the order, to read carefully these General Terms and Conditions, which can be accessed at any time via a dedicated link in the Site footer. These General Terms and Conditions will also be referenced at the time of order confirmation via a special link.
The Seller reserves the right to modify or supplement these General Terms and Conditions, even without notice. Such changes take effect from the time of their publication on the Site, it being understood that each order will continue to be governed exclusively by the terms and conditions in force at the time the order is placed.
GOODS AND SERVICE DESCRIPTION
B-Secure is an anti-theft device that, in the event of theft, allows you to view the location of the hive in real time using GPS geolocation technology. Through the mobile Application "Antifurtoarnie," which can be downloaded for free from major app stores, the Buyer can check at any time parameters such as the hive’s internal temperature, humidity, and real-time location via GPS.
The images of the goods offered for sale may, in some cases, not exactly match the actual products. The images and colors should therefore be considered as indicative and for illustration purposes only. The Seller shall not be liable for any discrepancy in images or colors of the goods due to these reasons.
In the case of temporary unavailability of an ordered product, the Seller will notify the Buyer.
The main features of the goods are indicated on each product’s page. For any requests for clarification or additional information, the Buyer may contact the Seller at the contact details indicated on the website.
BUYER'S OBLIGATIONS
The Buyer undertakes to use the service exclusively for lawful purposes and not contrary to mandatory laws, customs and practice, or rules of diligence, accepting all responsibility in case of failure to comply with the provisions mentioned.
The Service involves the use of an identification code and/or a password provided via confirmation email. The Buyer acknowledges and accepts that if third parties become aware of their authentication credentials, these third parties could make unauthorized use of Services in their name.
The Buyer therefore agrees to keep and use such credentials with the utmost confidentiality and care and to promptly notify in writing any unauthorized use of their identification codes and/or passwords and any other security breaches of which they become aware, including their possible theft, loss, or misplacement.
SERVICE NOTES
The service is available 24 (twenty-four) hours a day, 24 (twenty-four).
The Seller may suspend and/or interrupt the service to carry out necessary and/or appropriate ordinary or extraordinary maintenance, undertaking in such cases to perform the interventions as quickly as possible. In such cases, the Buyer cannot make any claim for compensation, reimbursement and/or damages for the period during which they were unable to use the service.
No guarantee is provided that the service is suitable for specific and/or even partially different purposes from those stated at the time the agreement is entered into. All forms of express or implied warranty are expressly excluded, to the extent that this does not conflict with current laws.
The Buyer undertakes to promptly report, in any event within 24 (twenty-four) hours, any irregularities or malfunctions in the service by writing to the indicated email address. Any damages caused by late reporting will be considered the exclusive responsibility of the Buyer.
The service provided is guaranteed by an SLA (Service Level Agreement) set at 99.5% annually, with downtime defined as periods of unavailability of the service.
The downtime period is calculated starting from the date and time provided in the report, which the Buyer must submit as described above, until the service becomes available again.
The following are expressly excluded from SLA coverage:
Force Majeure, i.e., all events outside the Seller’s control that may result in downtime. By way of example and not limitation: downtime due to natural disasters, hardware failures, and/or network issues not attributable to the Seller;
Acts of third-party suppliers not attributable to the Seller;
Acts of the Buyer, including but not limited to, line malfunctions, malfunction and/or incorrect configuration of installed software, non-payment or late payment of fees;
Scheduled maintenance and updates.
INTELLECTUAL AND INDUSTRIAL PROPERTY
Any materials subject to intellectual and/or industrial property rights made available to the Buyer under this agreement must be used in accordance with the relevant licenses and/or applicable law. The Customer accepts all responsibility in this regard and undertakes to indemnify and hold the Seller harmless from any liability arising from improper use.
HOW TO MAKE A PURCHASE
To complete a purchase, the Buyer must enter all data required by the form after reviewing the privacy policy available on the website.
Purchasing the Goods may be carried out according to the instructions and technical steps described on the site, in accordance with the following instructions:
select one or more goods from the catalog and add them to the cart by clicking the “add to cart” button
specify the quantity of goods desired, verify the delivery method (shipping address, payment method), accepting the related charges;
accept these general terms of sale and the privacy policy after having read them carefully;
confirm the order.
After confirmation, the Buyer will receive an email containing a summary of the Order placed, product details, quantity, price (including VAT, shipping and any additional charges) and a link to these General Conditions.
Every order must be complete in all parts and must contain all the information necessary to be properly processed. The order is considered placed when the Buyer has correctly filled out the online form without any error messages: the Buyer is required to verify the correctness of each order before confirming it.
The Buyer may modify or correct the order before confirming it; after confirmation, the order can no longer be modified.
If the contents of the Order and/or these General Conditions are not accepted, it will not be possible to finalize the Order.
Each Order confirmed by the Buyer will be stored electronically or in paper form at the Seller’s headquarters.
PAYMENT METHODS
Each Product offered for sale is described and can be viewed on the Site along with photographic images and the relevant unit price. The price is exclusive of VAT.
The goods offered for sale and their prices are valid as long as they are visible on the website and while stocks last.
Shipping costs are not included in the sale price but will be indicated separately during the purchase process, before the Order is submitted by the Buyer.
Payment may be made by the Buyer by credit card or bank transfer to the indicated account. The payment management services allow the website to process payments by credit card, specifying that the data used for payment is acquired directly by the provider of the requested payment service, without being in any way handled by the Seller. Some payment services may also allow the scheduled sending of messages, such as emails containing invoices or payment notifications.
This site uses the payment service provided by PayPal, which allows the Buyer to make online payments as described in the privacy policy and the service’s general conditions available at https://www.paypal.com/it/webapps/mpp/ua/privacy-full
The Buyer may not claim rights or raise any objections unless they have correctly and fully made payments as agreed.
The "Gps" and "GPS con senseri" products are equipped with an ESim. The ESim comes with an annual subscription that must be renewed every 12 months. At expiry, the device will cease to function until renewal, which must be made within the following 3 months. Upon renewal, 12 months will be added to the previous expiry date. After 3 months, the ESim will be deactivated, and payment of €20+VAT will be required for reactivation, in addition to the annual fee.
SHIPPING TIMES AND COSTS
Shipping costs are automatically calculated by the platform at the time of the order.
Goods are shipped at the Buyer’s own risk.
The delivery times for goods purchased online are on average 6-7 working days from receipt of confirmation of payment from the Buyer.
These terms are indicative and not binding, therefore the Seller accepts no responsibility in case of delays, it being understood that the order will be fulfilled, at the latest, within thirty days from the date of receipt of the order.
The goods purchased will be delivered to the address indicated by the Buyer when placing the order. If the Buyer wishes to receive the goods at a different address, they can indicate this in the notes section of the order form.
LIMITATIONS OF LIABILITY
The information regarding the goods provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors, for which the Seller cannot be held liable, except in cases of willful misconduct or gross negligence.
The Seller reserves the right to correct any errors, inaccuracies, or omissions after the Order has been submitted, as well as to change, update, or supplement information at any time without notice.
Any contractual or extra-contractual liability of the Seller is excluded in case of non-acceptance or incomplete fulfillment of an Order, excluding any right of the Buyer to compensation or indemnification, except in cases of willful misconduct or gross negligence and, in any case, without prejudice to the refund of the portion of the price paid for Orders not fulfilled or partially executed.
It is the responsibility of the Buyer, at their own care, expense, and risk, to procure all necessary equipment to access and use the service as described. In particular, equipment and accessories must be used that are approved according to current standards, in perfect working order, and that do not cause interference and/or damage to the enjoyment of the service. Responsibility for use of such equipment and the service rests solely with the Buyer, who will also be solely and exclusively responsible for any damage, cost, expense, and/or indemnification resulting from violation of the above.
The Seller does not warrant the perfect compatibility of the equipment and software used by the Buyer for the service.
RETURNS AND CLAIMS
Any quantitative disputes or complaints relating to the goods must be made, under penalty of forfeiture, no later than the time of delivery, by notifying the carrier, who will record it on the delivery document.
Any hidden defects must be reported, under penalty of forfeiture, within 7 working days of delivery, by written complaint to Via Galilei 2 Faenza 48018 (Ra) Italy, specifying the discrepancies found and attaching supporting documents. Reports received after this deadline will be considered invalid.
The methods and conditions of return will be agreed in advance. In the case of damaged and/or defective products, the Seller will be liable only for the value of those products.
Returned goods must be in perfect condition and in the original packaging.
Once the Seller has checked the returned goods, a refund minus the shipping costs incurred will be processed within 14 days of receipt of the goods.
SUPPORT
In case of faults with the supplied equipment, the customer is responsible for shipping the goods to the address indicated by the service center. To avoid shipping and return charges for repaired goods, as many remote tests as possible should be carried out to try to resolve the issue remotely if possible.
If the malfunction is due to a manufacturing defect, the return shipping costs are covered by the company and a €7 credit will be issued to cover outbound shipping costs, directly redeemable or usable on a future purchase.
If the malfunction is caused by misuse or improper management of the equipment, the return shipping costs and any repair costs will be borne by the customer, as damages caused are not covered by the warranty.
APPLICABLE LAW AND JURISDICTION
For matters not expressly provided for in these General Terms and Conditions, the Parties expressly refer, to the extent compatible, to the provisions of Italian law in force at the time of the contract.
For any and all disputes relating to the contract, the Court of Forlì shall have exclusive jurisdiction.
